Submission timelines

What to expect after you've posted your completed forms.

Timelines are set by HMCTS and HMRC and are outside our control. Every estate is different. Timelines can vary. The below reflects the typical experience of our customers.
Excepted estates (probate forms only)
Once your application is received by HMCTS they quote eight to twelve weeks. In practice most of our customers receive their Grant within four to eight weeks, and many receive it sooner than that.
Estates requiring IHT400 submission
Even where there is no inheritance tax to pay, some estates are required to submit IHT400 forms to HMRC, for example to claim the Residence Nil Rate Band. In these cases your completed IHT400 and schedules go to HMRC first. HMRC then issue a probate code, typically within three to four weeks. You enter that code into the platform, generate your final probate forms and post them to HMCTS. The same four to eight week Grant timeline then typically applies.

You cannot use the platform if the deceased was not domiciled in England or Wales or if they were married or had a civil partner, their surviving spouse was not domiciled in England or Wales.

When you cannot use the platform
In addition to the domicile outside of England or Wales if any of the following apply to the person who died or their estate you cannot use our platform.
Contested probate or disputed Wills
The deceased made gifts with reservation of benefit.
You need to claim Business Asset Relief (on assets other than stocks and shareholdings), Agricultural Relief or claim Heritage Assets Conditional Exemption.
Assets held in trust for the deceased.
